By accessing or using SpecMind services (the "Platform"), operated by Pareidolia LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Service

SpecMind provides specification management and development tools designed to help teams create, maintain, and enforce specifications throughout the software development lifecycle.

Specific capabilities, deployment models, and service levels are defined in separate agreements and are not implied by these Terms of Service.

3. Account Registration and Security

To use certain features, you may need to create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use
Be responsible for all activities under your account

4. Acceptable Use

You agree NOT to:

Violate any laws or regulations
Infringe on intellectual property rights
Interfere with or disrupt the Platform
Attempt to gain unauthorized access to systems
Use the Platform for malicious purposes
Reverse engineer or copy proprietary features

5. Intellectual Property

The Platform, including all content, features, and functionality, is owned by Pareidolia LLC and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you create using the Platform, subject to our rights to use such content to improve our services.

6. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in the Privacy Policy.

7. Payment and Fees

Some features may require payment. You agree to:

Pay all fees associated with your account
Provide valid payment information
Pay applicable taxes
Accept that fees are non-refundable except as required by law

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Guarantees of accuracy, reliability, or availability
Warranties that the Platform will be error-free or uninterrupted

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAREIDOLIA LLC SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or security breaches

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Pareidolia LLC from any claims, damages, losses, or expenses arising from:

Your use of the Platform
Your violation of these Terms
Your violation of any third-party rights

11. Termination

We may suspend or terminate your access at any time, with or without cause or notice. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Platform immediately ceases. Provisions that by their nature should survive termination will survive.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes. Continued use of the Platform after changes constitutes acceptance of modified Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for claims that may be brought in small claims court.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pareidolia LLC regarding the Platform.
